August 1st, China's Market Supervision Administration to pilot trial entrustment conversion to formal entrustment for part of concentrated antitrust review
TechFinance APP has learned that on July 31, the China's Market Supervision Administration published a notice titled "Announcement on converting pilot trial entrustment to formal entrustment for part of concentrated antitrust review", deciding from August 1st onwards to convert pilot trial entrustment to formal entrustment. This will enable the administration to entrust Beijing, Shanghai, Guangdong, Chongqing, and Shaanxi provinces (directly administered municipalities) with conducting reviews of cases that are suitable for simplified procedures.

On July 31, the China's Market Supervision Administration published a notice titled "Announcement on converting pilot trial entrustment to formal entrustment for part of concentrated antitrust review", deciding from August 1st onwards to convert pilot trial entrustment to formal entrustment. This will enable the administration to entrust Beijing, Shanghai, Guangdong, Chongqing, and Shaanxi provinces (directly administered municipalities) with conducting reviews of cases that are suitable for simplified procedures.
From August 1st, 2022 to July 31st, 2025, China's Market Supervision Administration conducted pilot trial entrustment work on concentrated antitrust review. Over the past three years, the administration has pushed forward with the pilot work, fully leveraging the advantages of provincial-level market supervision departments in being close to enterprises and markets, better serving enterprise applications for concentrated antitrust review. A total of 1,288 cases have been entrusted to local reviews, accounting for 54% of all cases during this period, with a total transaction value exceeding RMB 30 trillion. After evaluation, the pilot work has shown significant results, with the current entrustment mechanism running smoothly, the standard and scope of entrustment cases being reasonable, the flow process of entrustment reviews being efficient and smooth, and the concentrated antitrust review effectiveness having been improved, regulatory capabilities constantly strengthened, and work coordination achieving a higher level. The purpose of implementing the entrustment system has been met.
To consolidate the results of the pilot work, ensure the stability and continuity of audit work, China's Market Supervision Administration has decided to convert the pilot trial entrustment model that has proven effective into a standardized formal entrustment system. This will benefit the development of concentrated antitrust review classification and grading systems, further improve the effectiveness of concentrated antitrust reviews, and allow for better utilization of concentrated antitrust reviews in maintaining market fairness and promoting the vitality of enterprises.
Next, China's Market Supervision Administration will continue to strengthen supervision and guidance over provincial-level market supervision departments entrusted with review work, ensuring that audit work is uniform, standardized, and efficient.
