Jingdong Car's "Shock Price" Constitutes Unfair Competition, Ordered to Pay Compensation to Touge Car

Phoenix News Technology News August 4th, Jingdong Car released a statement on its official account "Jingdong Automobile", stating that the Shanghai Intellectual Property Court has determined that the three defendants' relevant behaviors in the "Shock Price" promotional activities constitute unfair competition. Therefore, this declaration is made to eliminate any impact.

According to an understanding, on July 21st, 2025, the Shanghai Intellectual Property Court has made a final judgment on the "Shock Price" case, with Touge Car prevailing and Jingdong Car's appeal being rejected. The court ruling has taken effect. The court found that Jingdong Car had implemented commercial defamation and false promotional behavior, not only constituting unfair competition but also causing consumers to misunderstand in specific scenarios.

The dispute between Touge Car and Jingdong Car over unfair competition began in September 2023. At the time, Jingdong Car launched a series of marketing activities centered around "Shock Price" as its promotional core slogan. In January 2024, Touge Car formally sued Jingdong Car for unfair competition, with the lawsuit lasting nearly two years.

The Shanghai Intellectual Property Court's second-instance judgment states that Jingdong Car's "Shock Price" low-price marketing activities and promotional slogan claiming to be "5% lower than competitors" are likely to cause consumers to misunderstand in specific scenarios, constituting false promotional behavior. The series of marketing activities themselves also constitute commercial defamation behavior, which constitutes unfair competition. The court ordered Jingdong Car to immediately stop its unfair competition behavior towards Touge Car. In addition, the court ruled that Jingdong Car must compensate Touge Car for economic losses of 500 million yuan and require Jingdong Car to publish a statement on its WeChat public account, video account, microblog, official flagship store on Douyin, and Jingdong Car app within 10 days of the judgment taking effect, eliminating any impact on Touge Car's rights.
